Terms of service

Welcome to Crinklet. These Terms of Service ("Terms") apply to your use of crinklet.com (the "Site") and to any purchase you make from Crinklet ("Crinklet", "we", "us" or "our"). By using the Site or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Refund Policy. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least the age of majority where you live, or have permission from a parent or guardian, to place an order. You agree to give accurate and complete information at checkout.
2. Our products
Crinklet pieces are handmade squishy toys with a crunchy coating, made in small batches. Because each one is made by hand:
- colour, shape, size and finish will vary slightly from piece to piece and from the photos on the Site;
- small surface marks, bubbles or uneven edges are part of the handmade character and are not defects;
- the crunchy coating is designed to crack and shed as you play, and the piece will soften over time. This is normal wear, not a defect.
Screen settings can also change how colours look. We try to show each item as accurately as we can.
3. Safety
- Not food. Crinklet pieces may look like food but must never be eaten, chewed or put in the mouth.
- Choking hazard. Contains small parts and pieces of coating can break off. Not suitable for children under 3 years. Children of any age should be supervised during play.
- Keep away from pets, heat, open flames and direct sunlight. Do not wash in water unless the product page says it is safe to do so.
- Stop using any piece that is torn or leaking and throw it away.
You are responsible for using the products as intended and following these warnings.
4. Prices and payment
Prices are shown in Canadian dollars (CAD) for Canadian customers and in U.S. dollars (USD) for customers in the United States, unless stated otherwise. Taxes and shipping are calculated at checkout. We may change prices at any time, but the price charged is the one shown when you placed your order.
We accept the payment methods shown at checkout. By submitting payment details, you confirm you are authorised to use that payment method.
5. Orders
Your order is an offer to buy. We accept it when we ship it. We may refuse or cancel any order, or limit quantities, for example if an item is out of stock, if there is a pricing or description error, or if we suspect fraud. If we cancel an order you have already paid for, we will refund you in full.
We work hard to keep stock, prices and product details accurate, but mistakes happen. We reserve the right to correct errors at any time, including after an order has been placed.
6. Shipping, returns and refunds
Shipping is covered by our Shipping Policy. Returns, refunds and cancellations are covered by our Refund Policy. Risk of loss passes to you when the carrier confirms delivery to the address you gave us.
7. Intellectual property
All content on the Site, including the Crinklet name and logo, product designs, photos, videos, illustrations and text, belongs to Crinklet or its licensors and is protected by copyright and trademark law. You may not copy, reproduce, sell or use it for commercial purposes without our written permission. Sharing our posts and tagging us on social media is welcome.
8. Reviews and content you send us
If you send us reviews, photos, videos or other content (for example by tagging us or submitting a review), you give us a non-exclusive, royalty-free, worldwide licence to use, display and share it in connection with Crinklet, with credit where practical. You confirm the content is yours and does not break any law or anyone else's rights. We may remove any content at our discretion.
9. Acceptable use
You agree not to misuse the Site, including by trying to access it without authorisation, interfering with its operation, scraping it, uploading malicious code, or using it for anything unlawful or fraudulent.
10. Third-party services
The Site runs on Shopify and uses third-party services for payments, shipping and analytics. Links to other websites are provided for convenience; we are not responsible for their content or practices.
11. Disclaimer
To the fullest extent permitted by law, the Site and products are provided "as is" and "as available", without warranties of any kind beyond those that cannot be excluded under applicable consumer protection law. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
12. Limitation of liability
To the fullest extent permitted by law, Crinklet will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim relating to an order is limited to the amount you paid for that order.
13. Indemnity
You agree to indemnify and hold Crinklet harmless from claims arising from your breach of these Terms or your misuse of the Site or products.
14. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Any dispute will be handled by the courts of Ontario, unless the consumer protection laws where you live give you the right to bring a claim in your local courts.
15. Changes
We may update these Terms from time to time. Changes apply to orders placed after the updated Terms are posted. The "Last updated" date at the top shows the latest version.
